Our detailed terms of business are listed below, however we also have some general guidance here.
Our approach is to be as clear as possible, and give you all the information we can about your online transactions so that you completely understand the whole process, from order to delivery and beyond. It’s really important to us that your online shopping experience meets expectations, so please spend a few minutes and read on. By using our website you will be accepting our T’s & C’s every time you make a purchase – they might change from time to time, so do check the date at the top of the page.
Placing an order - Mistakes and Communication
Firstly, don’t panic if you make any mistakes during your order, you can correct any input errors right up until you confirm payment. Once you’re happy everything is correct and you’ve submitted an order you’ll be given an Order Reference Number and details of the products you have ordered. You’ll then receive an email headed ‘Order Acknowledgement’ recognising receipt of your order. We will then send a further email headed ‘Order Confirmation’. This second email also lets you know how your products will be delivered to you. If we have to cancel all or part of your order for any reason, we will email you to let you know.
Sometimes we have to hold our hands up and admit we have made a mistake by unintentionally publishing inaccurate information on the site (e.g. the price, description or availability). In this instance we may have to cancel your order at any time up to the point we send you the product(s), even if you have received your Order Confirmation email, and you will receive a full refund of any charges already paid.
Currency & Carriage
As you would expect all our prices are in UK pounds. The total cost of your order will be the price of the products you order, plus delivery charge. You’ll see all these in your Shopping Basket before you submit an order. Payment is deducted once an order is submitted.
Our Products are delivered by courier or by post, generally within 1-3 days to mainland UK addresses only. Ireland: North and South, Scotland, Highlands and Island's deliveries are from 3-6 days.
We use Parcelforce and sometimes other couriers. If tracking information is available we will share it with you.
None of our support information or Terms and Conditions affect your Statutory Rights.
Full Terms of and Conditions of Business
1 General
All goods supplied by use are sold only on the following conditions. The placing of an order for any such goods, or the acceptance of our quotation or delivery of the goods includes acceptance of the following conditions. Unless expressly stated in our quotation, all descriptions, illustrations, drawings, dimensions, weight, measures, specifications, standards of performance or other descriptive matter are approximate only and shall not form part of the contract. Our record of any order placed by you verbally shall be conclusive as to the type and quantity of product and the timing of delivery. The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are to the fullest extent permitted by law, excluded from these conditions. These conditions shall apply to any repaired or replacement goods supplied.
2. Validity
All goods are offered subject to their being available upon receipt of the order.
3. Delivery
Delivery is offered at cost as quoted or occasionally free delivery may be offered subject to the total value of your order and at our discretion. The risk in all goods passes to you when they are delivered to your premises or place specified by you as the delivery address.
4. Delivery Time
All dates and times quoted for delivery are approximate and cannot be guaranteed by us unless made by our vehicle for local deliveries only. For the avoidance of doubt such delivery dates and times given to you shall not create a contractual obligation to deliver and accordingly no liability shall be accepted by us for any claim by you or any third party for direct or consequential loss arising from a delay in delivery.
5. Delay in Delivery
Should our shipment not be accepted by you at the time of delivery we reserve the right to pass on costs incurred with the delay or storage of the delayed goods. We shall be entitled to payment as if the goods had been duly delivered.
6. Acceptance
Unless you provide written notice within 7 days from the date of delivery that the goods are not in conformity with the contract you are deemed to have accepted the goods.
7. Passing of Property
Each of the following sub clauses are separate and severable and shall be enforceable accordingly:
7.1 Notwithstanding delivery, all goods supplied by us will remain our absolute property until you pay in full for them and for all other goods previously supplied to you by us;
7.2 You will store the goods in such a way that they are readily identifiable as our property but you may sell them to a third party in the normal course of your business;
7.3 Upon any sale of the goods all rights which you have against the buyer shall automatically vest in us;
7.4 We shall be entitled immediately after giving notice of our intention to repossess, to enter upon premises and repossess any goods to which we have title under this clause;
7.5 If you incorporate the goods we supply to you into other products or without materials you already possess or which are supplied to you by third parties the property in such other product will pass to us and you shall store them without charge on our behalf as bailee;
7.6 You shall not be entitled to pledge or in any way charge by way of security any of the goods which remain our property but in the event you do so all monies owing by you to us shall without prejudice to any other right or remedy available to us forthwith become due and payable.
8. Loss or damage in transit
Any shortage or damage must be notified to us in writing with 48 hours of the time of delivery otherwise no claim will be entertained. The package and contents should be retained for examination. Our limitation under this clause is limited to making up the shortage or replacing the goods proved to have been damaged or lost in transit to the point of delivery, and we accept no liability for any loos or damage suffered by you or caused by you whether direct or consequential and howsoever arising.
9. Prices
All goods are sold subject to the prices and any relevant discounts ruling at the time of delivery. Our prices, discount rates and condition of sale may be altered at any time without notice. All discounts and prices are calculated on a whole order basis and we reserve the right to review the discounts and prices at which such orders are accepted.
10. Payment
Payment in full without retention or set off and in cleared funds shall be due no later than the end of the month following that in which the goods were delivered or earlier on demand. If you do not comply punctually with these terms we reserve the right to charge you interest on any amount overdue at the rate of 8% plus Bank of England base rate together with the payment of any fixed and reasonable costs incurred by us and without notice to suspend all further deliveries until all arrears and have been paid and at our option rescind any subsisting contract with you to all or any parts of future deliveries.
11. Performance
It is your responsibility to determine that the goods are sufficient and suitable for the purpose for which they are to be put. We cannot accept any responsibility either in respect of the installation of any goods or the ultimate performance of any product. We shall in no way be liable for any direct or consequential damage, loss or expense arising from any defect or inefficiency cause by the manner in which the goods are used.
12. Defects after delivery
We offer a 12 month warranty on all goods except clothing. We retain the right to offer a repair or replacement as we see fit. Our warranty is null and void any case where the goods develop a defect due to misuse or use not intended. Our decision is final.
13. Return of goods
In no circumstances should goods be returned without first making contact with us and without a completed return form as supplied by us, and our acceptance of the return. All goods must be securely packed preferably in their original packaging and be unused and fit for resale.
14. Termination
We may without prejudice to our other rights and remedies determine the contract or any unfulfilled part of it or withhold further deliveries or make partial deliveries at our discretion.
15. Waiver
Any failure by us to enforce any or all of these conditions shall not be construed as a waiver of our rights hereunder.
16. Rights of Third Parties
For the avoidance of doubt the provisions of the Contracts (Rights of Third Parties Act 1999) shall not apply to any term of condition hereof and nothing contained herein shall confer on any third party any benefit or right to enforce any term or condition hereof.
